The Lifelong Guardianship & Advocacy Network

The Core Vision: A dedicated legal, financial, and protective framework ensuring that residents are permanently shielded from systemic vulnerability, exploitation, or abandonment.

The Four Pillars of the Legal & Advocacy Network

Supported Decision-Making (SDM) & Person-Centered Guardianship

  • Preservation of Personal Autonomy Prioritizes Supported Decision-Making (SDM) agreements wherever legally and functionally possible, enabling neurodivergent adults to retain their civil rights while receiving structured assistance from a trusted panel of advocates.
  • Fiduciary & Person-Centered Guardianship When full or limited legal guardianship is required due to severe cognitive or communication needs, the network serves as a court-appointed co-guardian or primary corporate guardian—exercising substituted judgment strictly aligned with the resident’s known values, preferences, and faith.
  • Proactive Civil & Disability Rights Protection Continuous legal monitoring to ensure all residents are fully protected under state and federal disability legislation, including the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act, and state-level healthcare advocacy laws.

Special Needs Trust (SNT) & Estate Stewardship

  • First-Party & Third-Party Special Needs Trusts Legal coordination for establishing and managing pooled or individual Special Needs Trusts (SNTs) and ABLE Accounts.
  • Protection Against Financial Exploitation Multi-party oversight protocols—including independent audits, dual-authorization banking controls, and transparent reporting—shielding residents’ personal funds, stipend earnings from the vocational guilds, and long-term inheritance from financial abuse or scams.
  • Frugal & Perpetual Asset Management Long-term trust management structured to ensure that capital assigned for a resident’s lifelong care is conservatively invested and legally earmarked exclusively for their housing, medical care, personal enrichment, and burial expenses.

Independent Personal Advocacy & “Permanent Family” Panels

  • The “Stand-In Advocate” System Assigns each resident a Volunteer Guardian ad Litem or Designated Personal Advocate who meets with them regularly, attends care-plan reviews, and ensures their daily quality-of-life choices (food, social life, hobbies, roommates) are honored.
  • Medical Proxy & Healthcare Power of Attorney Clear, legally binding advance directives and healthcare proxy designations that uphold Catholic bioethical principles—ensuring residents receive excellent, dignity-affirming medical care while protecting them from forced or non-consensual medical interventions.
  • Care-Plan Continuity & Audit Boards An independent review panel composed of disability attorneys, bioethicists, social workers, and family representatives that conducts unannounced, semi-annual audits of living conditions, clinical care quality, and financial management across all cottages and wings.

Transition, Grief & Legacy Continuity

  • Parental Succession Planning Comprehensive legal blueprints created alongside biological parents decades before needed, mapping out every detail of a resident’s life history, emotional triggers, favorite routines, medical nuances, and family traditions.
  • Grief-Informed Legal Transition Support Immediate legal and emotional mobilization upon the illness or death of a biological parent—ensuring the resident’s housing, financial access, and care team remain completely uninterrupted while providing trauma-informed grief support.
  • Sacramental & End-of-Life Directives Pre-funded and legally protected end-of-life arrangements that guarantee every resident receives Catholic funeral rites, proper burial, and perpetual remembrance within the foundation’s prayer community.
